Fresh Planty Shop is an online retailer dedicated to providing high-quality plants, gardening supplies, and outdoor living products to gardening enthusiasts and homeowners around the world. These Terms govern your use of our website and your purchase of any products from us. By using our site, you confirm that you are at least 18 years old and are accessing us from a region we serve.

2. Product & Service Description

We take great care to accurately display the colors, features, and descriptions of our products. However, the actual colors and details you see will depend on your monitor and device; we cannot guarantee it will be identical.

• Product Nature: We sell live plants (e.g., Apple Trees, Clematis, Blueberry Plants), bulbs, tubers, garden tools (e.g., Chainsaws, Blowers), and outdoor furniture (e.g., Dining Sets, Barbecues).
• Live Product Variability: Please understand that live plants are natural products and may vary slightly in size, color, and shape. This natural variability is not a defect.
• Seasonality: Some plants are seasonal. We ship them at the appropriate time for planting in your region to ensure the best chance of success.

3. Ordering & Payment Terms

When you place an order, you are making an offer to purchase our products subject to these Terms.

• Order Acceptance: Your order is accepted only when we send a shipping confirmation email. We reserve the right to cancel any order for reasons including, but not limited to, product unavailability, errors in product or pricing information, or issues identified by our fraud prevention team.
• Pricing: All prices are listed in US Dollars (USD). We reserve the right to change prices at any time without notice.
• Payment Methods: We accept payments securely via Visa, MasterCard, JCB, and PayPal. By providing your payment information, you confirm you are authorized to use the payment method.
• Your Responsibility: You are responsible for providing accurate and complete billing and shipping information. Incorrect addresses may lead to delays or lost shipments.

4. Shipping & Delivery

Our goal is to get your green friends to you safely and promptly.

• Processing: Orders are processed within 1-2 business days after payment confirmation.
• Shipping Methods:
  • Standard Shipping: $12.95 fee. Shipped via DHL/FedEx. Delivery in 10-15 business days after dispatch.
  • Free Shipping: Available on orders over $50. Shipped via EMS. Delivery in 15-25 business days after dispatch.
• Shipping Areas: We ship globally but are currently unable to deliver to some parts of Asia and a few remote regions due to customs restrictions.
• Delivery Delays: We are not liable for delays caused by weather, customs, carrier issues, or other events beyond our reasonable control (“Force Majeure”).

5. Returns, Refunds & Exchanges

Your satisfaction is our priority. Our policy is designed to be fair while accounting for the perishable nature of our products.

• Timeframe: Returns or exchanges must be requested within 15 days of you receiving your order.
• Non-Returnable Items: For health and safety reasons, the following cannot be returned unless they arrive damaged or defective:
  • All Live Plants (e.g., Fruit Trees, Climbers, Bedding Plants)
  • Bulbs & Tubers (e.g., Begonia, Dahlia, Crocus, Daffodil)
  • Opened or used bags of Fertilisers.
• Eligibility: To be eligible, the item must be unused, unplanted, and in its original packaging. Proof of purchase (order number) is required.
• Process: Email us at [email protected] within the 15-day window to initiate a return. Return shipping costs are the customer’s responsibility unless the error was ours.
• Refunds: Refunds are issued to the original payment method within 7-10 business days after we receive and inspect the return. Original shipping fees are non-refundable.
• Damaged Items: If your order arrives damaged, you must contact us within 48 hours of delivery with photos of the damage. We will arrange a replacement or refund.

6. User Obligations & Responsibilities

As a valued customer, we ask you to:

• Provide accurate, current, and complete information during checkout.
• Use the website only for lawful purposes and not engage in any fraudulent activity.
• Promptly inspect your order upon delivery and notify us of any problems within the specified timeframes.
• Understand that you are responsible for caring for any live plants upon receipt, as we cannot control their environment after delivery.

All content on this website, including text, graphics, logos, images, and software, is the property of Fresh Planty Shop or our suppliers and is protected by international copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

8. Limitation of Liability

Fresh Planty Shop will not be held liable for any indirect, incidental, or consequential damages arising out of your use of our website or products. Our total liability to you for any claim related to your order or these Terms shall be limited to the value of the order in question.

9. Governing Law & Contact

These Terms and Conditions are governed by the laws of the State of Arizona, United States. Any disputes shall be resolved in the courts located in Maricopa County.
